Outfit7 Internship General Terms and Conditions
These Outfit7 Internship General Terms and Conditions (hereinafter: 'Terms') constitute an agreement between you and Outfit7 Neo Limited, a company organized under the laws of Cyprus, with a registered address at Christaki Kranou 20, 1st Floor, 4041 Limassol, Cyprus or/and its local affiliate where the Internship (defined below) will take place (hereinafter: 'we' or 'Outfit7').
If you are applying for an Internship position at Outfit7, these Terms shall apply to you in regard to the application and selection process. Please read these Terms carefully before submitting your application in order to fully understand the conditions and your obligations in regard to the Internship.
'Agreement' shall mean a cooperation agreement concluded between the Intern and Outfit7 for the purpose of performing the Internship.
'Confidential Information' means any non-public information made available to the Candidate during and/or in connection with the selection process or during the Internship that relates to actual or anticipated business or research and development of Outfit7, technical data, trade secrets or know-how, including, but not limited to information regarding Outfit7's products or services and markets, customer lists and customers, personal data, software, developments, inventions, processes, designs, drawings, engineering, hardware configuration information, marketing, finances or other business information. Confidential Information does not include information that (i) can be demonstrated by the Candidate to be known to the Candidate at the time of disclosure, (ii) has become publicly known and made generally available through no wrongful act of the Candidate or (iii) has been rightfully received by the Candidate from a third party who is authorized to make such disclosure.
'Intern' shall mean the Candidate who has been selected for an Internship position and has further concluded the Agreement.
'Internship'' shall mean a short-term cooperation experience offered by Outfit7 as described on the Website.
'you' or 'Candidate' shall mean the individual applying for an open Internship position at Outfit7, whether selected for the Internship position or not.
'Website' shall mean the website located at https://outfit7.com, in particular the subpage designated for open Internship positions at Outfit7.
In order to apply for the Internship, the Candidate must be at least 18 years old and in capacity to form legally binding contracts and meet the requirements as specified in the description provided on the Website. The Candidate must be proficient in the English language (both written and spoken) and must have the necessary right and status to reside and work in the country where the Internship will take place. Non-eligible Candidate will not be considered for the Internship position to which they apply.
Knowledge and experience in the industry is preferred but not an eligibility requirement, unless stated otherwise in the Internship description provided on the Website. The Candidate may be required to provide the documentation proving how they comply with the eligibility requirements.
III. SELECTION PROCESS
Individuals can apply for an open Internship position by filling out the application form provided on the Website.
Outfit7 will assess all candidates by taking into consideration their educational background, qualifications, competences and their motivation.
If chosen in the selection process, the Candidate will be offered the possibility to conclude the Agreement, which will constitute the basis on which the Internship will be performed. All candidates who have not been selected will be notified through electronic mail.
The Candidate has the right to withdraw their application at any time and applying for the Internship position does not create an obligation to conclude the Agreement.
During or subsequent to the duration of the application and selection process, the Candidate will not (i) use Confidential Information for any purpose whatsoever (for the Candidate's own benefit or the benefit of a third party) other than as reasonably necessary for participation in the Internship selection process; or (ii) disclose Confidential Information to any third party; or (iii) abandon due standard of care and therewith enable any person, firm, corporation or other entity to get access to any Confidential Information that the Candidate obtains, accesses, or creates during and/or in connection with the selection process or the Internship itself. The Candidate agrees that Confidential Information will remain the sole property of Outfit7. Moreover, the Candidate also agrees to take all reasonable precautions to prevent any unauthorized disclosure of Confidential Information. The Candidate will return or destroy all Confidential Information to Outfit7 upon Outfit7's request.
Without limiting the obligations set out in the previous paragraph, Outfit7 may also require that the Candidate signs a non-disclosure agreement for the purpose of protecting Confidential Information.
V. COMPLIANCE WITH LOCAL REGULATORY REQUIREMENTS
The Internship will take place on premises of Outfit7 as specified in the description provided on the Website and further defined in the Agreement concluded with the Intern. The Candidate is solely responsible for obtaining all necessary documentation to perform the Internship, including, without limitation the right to reside in the respective country of the Internship.
If, at any time before or during the Internship, the Candidate and/or the Intern fails to produce all documentation required by the local authorities to perform the Internship, Outfit7 shall have no obligation to procure such documentation for the Candidate and/or the Intern. If the Agreement has already been concluded, the Internship shall not be performed and such Agreement shall be considered null and void.
The Internship will be concluded for a fixed period of time. The estimated duration of the Internship will be specified in the Internship description on the Website and/or disclosed to the Candidate at any time during the selection process, whereas the commencement date and the exact duration of the Internship shall be specified in the Agreement.
Remuneration for the Internship will be defined in the Agreement. Additional expenses related to accommodation and travelling expenses will be borne by the Intern, unless expressly agreed otherwise in the Agreement. For the avoidance of doubt, Outfit7 may, at its sole discretion, decide to arrange accommodation or reimburse (part of) travel expenses incurred by the Intern, but has no obligation to do so.
VIII. EQUAL OPPORTUNITIES
Outfit7 applies an equal opportunities policy and will treat all candidates without any distinction based on grounds of sex, race, ethnic or social origin, genetic features, language, religion or belief, political or any other opinion, membership of a national minority, property, birth, disability, age or sexual orientation.
IX. REPRESENTATIONS AND WARRANTIES
BY APPLYING FOR THE INTERNSHIP, YOU REPRESENT AND WARRANT THAT (i) YOU COMPLY WITH ALL APPLICATION REQUIREMENTS SET OUT IN THESE TERMS, INCLUDING THAT YOU ARE ELIGIBLE TO APPLY TO THE INTERNSHIP POSITION; (ii) ALL INFORMATION THAT YOU PROVIDE TO OUTFIT7 DURING THE APPLICATION AND SELECTION PROCESS IS TRUE AND CORRECT; (iii) YOU ARE SOLELY RESPONSIBLE FOR OBTAINING ALL NECESSARY DOCUMENTS AND PERMITS THAT WILL ALLOW YOU TO PERFORM THE INTERNSHIP; AND THAT (iv) YOU WILL PROMPTLY NOTIFY OUTFIT7 OF ANY CIRCUMSTANCES WHICH MAY AFFECT THE SELECTION PROCESS AND YOUR ABILITY TO PERFORM THE INTERNSHIP.
YOU ACKNOWLEDGE THAT OUTFIT7 MAY, AT ITS SOLE DISCRETION, CHOOSE THE MOST SUITABLE CANDIDATE OR DECIDE TO TERMINATE THE SELECTION PROCESS AT ANY POINT.
IF THE AGREEMENT WITH THE INTERN HAS BEEN CONCLUDED, OUTFIT7 WILL HAVE NO OBLIGATION OF PROLONGATING SUCH AGREEMENT NOR TO CONCLUDE A NEW AGREEMENT AND ENGAGE THE INTERN FOR AN INDEFINITE PERIOD OF TIME. WHEN APPLYING FOR THE INTERNSHIP, YOU ARE AWARE AND UNDERSTAND THAT, IF SELECTED FOR THE INTERNSHIP POSITION, SUCH INTERNSHIP WILL NOT, NOR IS IT INTENDED TO, CONSTITUTE AN EMPLOYMENT RELATIONSHIP BETWEEN YOU AND OUTFIT7 NEO LIMITED (OR ITS LOCAL AFFILIATE).
XI. INDEMNIFICATION AND LIABILITY
The Candidate agrees to defend, indemnify and hold harmless Outfit7 and its directors, officers and employees from and against all taxes, losses, damages, liabilities, costs and expenses, including attorneys' fees and other legal expenses, arising directly or indirectly from or in connection with any reckless or intentionally wrongful act of the Candidate and any breach by the Candidate of any of the covenants contained in these Terms.
Furthermore, the Candidate agrees to exonerate and hold harmless Outfit7 and its directors, officers, and employees from and against all taxes, losses, damages, liabilities, costs and expenses, including attorneys' fees and other legal expenses, which may arise from or in connection with the application process and participation in any activities related to the Internship, whether or not foreseeable, to the fullest extent permissible by applicable law. Moreover, by agreeing to these Terms, the Candidate waives any and all claims for compensation that would arise or originate from the Internship.
XII. DATA PROTECTION
XIII. GENERAL PROVISIONS
Outfit7 reserves the right to amend these Terms at any time without prior notice to the Candidate. If any provision of the these Terms is found by any court or other authority of competent jurisdiction to be invalid, illegal or unenforceable, the validity and enforceability of the other provisions of the Terms shall not be affected and shall remain in full force and effect.
These Terms, and the relationship established hereunder, shall be interpreted and construed in accordance with the laws of Cyprus, without regard to its principles of conflicts of laws, and with the same force and effect as if fully executed and performed therein. Any suit, action or proceeding arising out of or in relation to these Terms shall be brought in the courts of Cyprus, which shall have the exclusive jurisdiction over any such suit, action or proceeding.
